Dear Ms. Reese:

 

The members of the WBAI Finance Committee, including me, were recently apprised in an e-mail disseminated by Mitchel Cohen, Secretary of the WBAI Local Station Board that the Pacifica Foundation had settled a lawsuit, which had been initiated by Lonnie Hicks.

 

Lonnie Hicks, former Chief Financial Officer of Pacifica, initiated a lawsuit alleging racial discrimination against Pacifica in the Superior Court of California, Alameda County, No. RG09446139.

 

In his e-mail Mitchel Cohen gave an approximate number of $300,000 as the settlement, which was paid by Pacifica.  This is supposed to be public information and is supposed to be reported in the financial statements.  And not the usual nonsense that Pacifica expects to prevail.  Obviously, Pacifica did not prevail.  It lost and, therefore, I have several questions which I expect to be answered.

 

The first question:  How much did Pacifica pay to Lonnie Hicks?

 

The second question:  Did Pacifica pay for Hicks’ legal bills?

 

The third question:  How much money did Pacifica expend in defending itself against this lawsuit?

 

The fourth question:  How much has WBAI and Pacifica spent to defend itself against Bernard White’s lawsuit, 11 CIV 2192, which was initiated in Southern District Court of the State of New York?  Your friend Carolyn Birden stated that all information pertaining to Bernard White’s lawsuit was privileged; this is a lie.

 

The fifth question:  What is the name, address and phone number of the accounting firm, which is auditing Pacifica’s financial statements.

 

The sixth question:  What is the name of Pacifica’s in-house attorney?

 

These questions are supposed to be public information and I expect a response.

 

Please note that it was your friend Carolyn Birden, who taunted me for not reporting violations of law to the authorities; Birden stated that I was liable if I did not report these crimes.  Unfortunately since Carolyn Birden, a member of the WBAI Local Station Board and member of the Pacifica National Board stated my fiduciary duty, I am therefore legally bound to report violations of law to the proper authorities.
